Katy Perry’s “Dark Horse” Copied Christian Rap Song, Jury Finds

 

On March 4, 2008, Christian Hip Hop artist FLAME released his track “Joyful Noise” featuring rapper Lecrae and John Reilly, off his fourth studio album Our World: Redeemed. He released his video a few months later.  Later, in 2013, Pop Singer Katy Perry released her song “Dark Horse” which had the same type of beat at “Joyful Noise.” Within the year of Perry’s release, Marcus Gray, aka FLAME, filed for a copyright infringement. This week, a California court agreed with Gray and ruled that the pop singer’s song is indeed a copyright infringement.

The Hollywood Reporter reports “The verdict means the case will proceed to a damages phase, which will begin Tuesday. Still pending is a motion from Perry’s lawyers on Thursday asking U.S. District Judge Christina Snyder to rule that no reasonable jury could find copyright infringement based on the evidence presented at trial.”

In 2009, “Joyful Noise” was a GMA Dove Award Nominee for Best Rap/Hip Hop Recorded Song of the Year. FLAME received a Stellar Award Nomination for Rap Album of the Year, and was Nominated for a Grammy Award for Best Rock or Rap Gospel Album. The 2008 album was the last of four albums signed to Cross Movement Records.

Since 2010, Gray released several albums under his own label Clear Sight Music and has won multiple awards and topped the Billboard Gospel Charts twice, #1 on iTunes Rap in March 2012. His current single “Capes” on out now on Spotify.
